These Terms of Service ("Terms") govern your use of thekagegroup.com (the "Site"), your purchase of KageGear apparel and KageFuel supplements, and your booking of KageMind performance coaching sessions (collectively, the "Services"), operated by THE KAGE GROUP ("Kage," "we," "us," or "our"). By accessing the Site or using the Services, you agree to these Terms.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to make a purchase or book a session. By using the Services, you represent that you meet this requirement.

2. Products — KageGear & KageFuel

  • Product descriptions, images, and pricing are believed accurate at the time of posting but may contain errors; we reserve the right to correct pricing or availability at any time.
  • We reserve the right to limit quantities, refuse orders, or cancel orders at our discretion, including in cases of suspected fraud or pricing errors.
  • Supplement disclaimer: KageFuel products are dietary supplements and are not intended to diagnose, treat, cure, or prevent any disease. Statements about KageFuel products have not been evaluated by the FDA or equivalent regulatory bodies. Consult a physician before use if you are pregnant, nursing, taking medication, or have a medical condition.
  • Shipping, returns, and exchanges are subject to our posted shipping and returns terms available on the Site.

3. KageMind Coaching Sessions

  • KageMind sessions, including the Initial Call and the 6-Week Program, are performance psychology coaching services delivered by Dr. Andrés Felipe Betancourt Rendón or other qualified KageMind practitioners.
  • Not medical or clinical treatment: KageMind coaching is educational and developmental in nature and is not a substitute for diagnosis or treatment of any medical, psychiatric, or psychological condition. If you are experiencing a mental health crisis, contact a licensed provider or emergency services in your area.
  • Booking, rescheduling, and cancellation: sessions must be booked through the Site. Rescheduling and cancellation requests must be made at least 24 hours in advance; late cancellations or no-shows may not be refunded or rescheduled at our discretion.
  • Payment: the Initial Call and the Full 6-Week Program are paid in advance at the prices displayed on the Site at the time of booking.
  • Outcomes from coaching depend on individual effort and circumstances; we do not guarantee specific results.

4. Payment

All prices are listed in USD unless otherwise stated. Payment is processed securely through our third-party payment processor at the time of purchase or booking. You represent that any payment information you provide is accurate and that you are authorized to use the payment method.

5. Account & Site Use

  • You agree to provide accurate information and to keep your account credentials confidential.
  • You agree not to misuse the Site, including attempting unauthorized access, interfering with Site operation, or using the Site for unlawful purposes.

6. Intellectual Property

All content on the Site, including the Kage name, logo, product designs, graphics, and text, is owned by or licensed to THE KAGE GROUP and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works from this content without our prior written consent.

7. Disclaimers

The Site and Services are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

8. Limitation of Liability

To the fullest extent permitted by law, THE KAGE GROUP and its officers, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site, products, or coaching Services, even if advised of the possibility of such damages. Our total liability for any claim arising from these Terms or the Services will not exceed the amount you paid for the product or service giving rise to the claim.

You agree to indemnify and hold harmless THE KAGE GROUP from any claims, damages, or expenses arising from your violation of these Terms or misuse of the Site or Services.

These Terms are governed by the laws of the jurisdiction in which THE KAGE GROUP is registered, without regard to conflict-of-law principles, unless otherwise required by applicable consumer protection law in your jurisdiction.
